Acceptance of Terms

By accessing or using OpsSignal (the "Service") at https://opssignal.dev, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Service Description

OpsSignal is a software-as-a-service that monitors GitHub Actions workflow failures through a GitHub App and delivers real-time notifications to Discord channels you configure.

The Service receives workflow failure events via GitHub webhooks. OpsSignal does not access, store, or analyze your source code, commit contents, or GitHub account passwords.

Beta Service

The Service may be offered in beta, early access, or preview form, including during our MVP period. In that case, features may be added, changed, or removed at any time.

We do not guarantee compatibility between releases, backward compatibility of configurations or integrations, or stability of any API, webhook behavior, or user interface. You use beta or preview features at your own risk.

User Responsibilities

You are responsible for your use of the Service and for maintaining the security of your accounts and integrations. You agree to:

• Provide accurate account information and keep it up to date
• Use the Service only in compliance with applicable laws and third-party terms (including GitHub and Discord policies)
• Keep your Discord webhook URLs confidential and rotate them if compromised
• Configure only repositories and channels you are authorized to monitor or notify
• Not misuse the Service, attempt unauthorized access, or interfere with its operation

GitHub Account Integration

The Service uses GitHub OAuth for sign-in and a GitHub App for repository access and webhook delivery. By connecting GitHub, you authorize OpsSignal to receive information described in our Privacy Policy, including repository metadata and GitHub Actions workflow failure events.

OpsSignal does not request or store your GitHub password. You may revoke access at any time through your GitHub account settings or by uninstalling the GitHub App.

Your use of GitHub is subject to GitHub's terms and policies. See Third-Party Services for limitations of our responsibility regarding GitHub.

Discord Webhook Usage

You may provide a Discord webhook URL so the Service can post failure notifications. You are responsible for ensuring you have permission to send messages to the chosen Discord channel.

OpsSignal stores your webhook URL to deliver notifications but does not store the content of messages sent to Discord beyond what is necessary to operate the Service. Treat webhook URLs as secrets; anyone with the URL may be able to post to your channel.

Your use of Discord is subject to Discord's terms and policies. See Third-Party Services for limitations of our responsibility regarding Discord.

Subscription and Billing

OpsSignal is offered as a subscription service. Paid plans and billing through Stripe are planned for a future release. When implemented, subscription fees, billing cycles, taxes, and payment methods will be disclosed before you are charged.

Until paid billing is enabled, access may be provided at no charge or under a trial, at our discretion. We may introduce or change pricing with reasonable notice where required by law.

If Stripe or another payment processor is used, payments will be subject to that processor's terms. Failure to pay applicable fees may result in suspension or termination of access.

Service Availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, updates, and events described in Force Majeure and Third-Party Services may cause downtime or delayed notifications.

The Service is provided on an "as available" basis. We may modify, suspend, or discontinue features with or without notice, subject to applicable law.

Force Majeure

OpsSignal is not liable for any failure or delay in performing our obligations, or for any loss or damage, to the extent caused by events beyond our reasonable control, including but not limited to:

• Natural disasters, earthquakes, floods, fires, or severe weather
• War, terrorism, civil unrest, or armed conflict
• Strikes, labor disputes, or other industrial action
• Power outages or telecommunications failures
• Internet or network failures
• Hosting provider failures
• Cloudflare outages or disruptions
• GitHub outages or disruptions
• Discord outages or disruptions
• Governmental actions, regulations, or orders
• Any other event beyond our reasonable control

During such events, our obligations may be suspended for the duration of the impediment.

Third-Party Services

The Service depends on third-party platforms and providers. OpsSignal does not control and is not responsible for their acts, omissions, availability, or policies. To the fullest extent permitted by law, we are not liable for any loss or damage arising from:

• Changes to GitHub APIs, permissions, webhooks, or product features
• GitHub outages, rate limiting, or discontinuation of services
• Discord outages, delivery failures, rate limiting, or policy enforcement
• Stripe outages, payment processing errors, or account restrictions (when billing is enabled)
• Cloudflare outages or security actions
• Hosting provider failures or capacity limits
• API rate limiting or throttling by any third party
• Discontinuation, deprecation, or material changes to third-party services

Your use of third-party services is governed by their respective terms and privacy policies. You are responsible for maintaining valid integrations and credentials on those platforms.

Intellectual Property

OpsSignal, including its software, design, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You retain ownership of your data and content on GitHub and Discord. You grant us a limited license to process data as needed to provide the Service, as described in the Privacy Policy.

Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that notifications will be delivered promptly, completely, or at all, or that the Service will detect every workflow failure you expect.

The Service is a supplementary notification aid, not a substitute for your own monitoring practices or incident response. You remain responsible for appropriately monitoring and managing your systems, repositories, and workflows, and you should not rely on OpsSignal alone for critical operational oversight or alerting.

Limitation of Liability

To the fullest extent permitted by law, OpsSignal and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising out of or relating to the Service shall not exceed the total amount actually paid by you for the Service during the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any fees during that period, our total liability shall be zero (USD 0).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

Account Suspension

We may suspend or restrict your access to the Service immediately, with or without prior notice, if we reasonably believe that you have engaged in conduct that:

• Abuses or misuses the Service
• Sends spam or unsolicited communications through the Service
• Launches or facilitates denial-of-service attacks or similar disruptions
• Attempts to access data or systems without authorization
• Poses a security threat to the Service, our users, or third parties
• Involves illegal activity
• Violates these Terms or applicable law

We may investigate suspected violations and cooperate with law enforcement where appropriate. Suspension is separate from termination and does not limit our other remedies.

Termination

You may stop using the Service at any time by disconnecting integrations and, if applicable, canceling your subscription.

We may terminate your access if you materially violate these Terms, if required by law, or if we discontinue the Service. Where reasonable and lawful, we may provide notice before termination, except where immediate action is required under Account Suspension.

Upon termination, your right to use the Service ends, and we may delete account data in accordance with our Privacy Policy.

Changes to the Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated through the Service or by email where appropriate.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms, unless applicable law requires otherwise.

Governing Law

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.

Any disputes will be subject to the exclusive jurisdiction of the courts located in Japan, unless otherwise required by applicable law.
